The same size/type replacement rule is fundamental to express permit eligibility in Los Angeles. When you replace an existing element with one of the same size and type, the work typically qualifies for express processing (5 days) because it doesn't change the building's characteristics. Failing this rule means your project needs a regular permit (~3 months).
What "Same Size and Type" Means
LADBS interprets "same size and type" strictly:
- Windows: Same dimensions, same operation type (single-hung for single-hung, slider for slider)
- Doors: Same dimensions, same swing direction, same type (hollow core for hollow core)
- Water heaters: Same capacity (gallons), same fuel type (gas for gas, electric for electric)
- HVAC units: Same BTU capacity, same fuel type
- Electrical panels: Same amperage rating
When the Rule Gets Tricky
Common scenarios where the same size/type rule trips up applicants:
- Upgrading from a standard water heater to tankless � different type, may not qualify for express
- Replacing a window with a larger one � different size, requires regular plan check (~3 months)
- Switching from gas to electric appliances � different type, may need additional review
- Adding energy-efficient upgrades that change system specifications
